What is a leave of absence? A leave of absence is a temporary, involuntary furlough of absence from an employee, after which the employee is expected to return to work or return to work after a short period of time. A leave of absence is often used when an employer does not have sufficient funds to pay wages (e.g., when a budget is not approved and the government is shut down) or when there are not enough jobs for all employees during a recession and the employer can avoid firing an employee by reducing work hours.

A terminated employee may be required to take a certain number of unpaid days off in a series of weeks, a certain number of unpaid days or hours in a year, or a single unpaid holiday. For example, an employer may require a terminated employee to be paid only 32 hours of pay for the remainder of the year, one day per week, instead of the usual 40 hours per week. Another example would be to require that all employees take several weeks of unpaid leave during the year.

Yes, an employee on leave may learn or train, i.e., maintain or upgrade skills, during the leave period, as long as the purpose is to improve the employee’s effectiveness in the employer’s business or the employer’s performance. The learning or training must not be for the purpose of providing services to, contributing to, or earning income from the employer (or the employer’s affiliated organization) that granted the leave.

Can an employee work voluntarily during a leave of absence?

Yes, employees on leave are entitled to engage in volunteer activities during their leave, including volunteer activities organized by the leave-granting employer. However, the activity must not benefit or generate income for the leave-granting employer (or the employer’s affiliated organization). The employer must also assist the terminated employee in finding voluntary opportunities during the leave.

Can an employer require an employee to check his or her email?

No. The employer may not require the employee to check his or her email. This would be a disservice to the employer during the leave. There is also a risk of violating the Code of Criminal Procedure by replying to an email or action item in an email that an employee receives, even if the employee only responds to one or two emails. Employers may want to consider removing access to work e-mail for employees on leave and setting up automatic forwarding of e-mails sent to employees on leave or allowing line managers to access their leave e-mail boxes.
